Jerrys Enterprises, Inc. (Jerrys) brought this action for legal malpractice against the law firm of Larkin, Hoffman, Daly & Lindgren, Ltd. and two of its shareholders, Thomas Stoltman and Gary Renneke (collectively, Larkin). Jerrys had previously retained Larkin to represent Jerrys in the purchase of undeveloped land in Woodbury, Minnesota. Jerrys alleges that Larkins representation fell below the standard of care and caused Jerrys to suffer monetary damages in the form of legal fees and settlement costs incurred in the process of clearing title to the property. At the close of Jerrys case, the district court granted Larkins motion for a directed verdict. The court of appeals reversed and remanded for trial. See Jerrys Enters., Inc. v. Larkin, Hoffman, Daly & Lindgren, 691 N.W.2d 484, 495 (Minn. App. 2005). In this appeal from that decision, we hold that questions of fact exist regarding whether Larkins representation fell below the standard of care and whether Larkins allegedly negligent conduct was the "but for" cause of Jerrys alleged injuries. We therefore affirm.
